Smida vs. Isanti Pines Tree Farm LLC, State of Minnesota, Court of Appeals, A15-0437 (2015) Attorneys Katie Wahlberg and Tom Olson successfully argued an appeal at the Minnesota Court of Appeals. The Court agreed that a non-exclusive easement for access over forested land planned for future development was properly created; then not lost by abandonment or adverse possession even though the land was left undeveloped and the easement has not yet been utilized.
