We have significant experience in representing the rights of those looking for a review of a purchase agreement or seeking to enforce or to exit a purchase agreement. We have assisted clients to bring or defend lawsuits for specific performance meaning that one party is trying to force a reluctant party to sell, or to buy. The other may be looking to withdraw from a sale due to dissatisfaction with financing, inspections, inability to sell another home where a contingency is in place, or issues with a completed Phase 1, Sellers can be obligated to disclose the conditions of the property and those conditions can be the source of a dispute whether the buyer can back out of the transaction.
We regularly review title commitments (commitment for policy of title insurance) and closing documents and are called upon by our clients to review loan commitment and the loan closing documents such as Promissory Note, Mortgage, or Settlement Statement. At times, an endorsement, or an escrow may be used to address a title issue.
Our lawyers have significant experience determining whether title insurance can be obtained to address or used in connection with curing a title problem, and whether some type of quiet title lawsuit could be used to correct problems.
